Vinay Mittal Takes Over as Chairman, Railway Board

Shri Vinay Mittal has taken over as the new Chairman, Railway Board and ex-officio Principal Secretary to the Government of India, Ministry of Railways, today (30th June 2011). He replaces Shri Vivek Sahai who superannuated today from this post. Prior to this, Shri Mittal was serving as General Manager, South Eastern Railway since 12th January, 2011.
Shri Vinay Mittal is an officer of Indian Railway Traffic Service (1975 batch). He has worked in various capacities all over the Indian Railways and has acquired vast and varied experience in the field of Railway Administration in his distinguished career. He has worked as the General Manager of North Western Railway, Addl. General Manager, Central Railway, Divisional Railway Manager-Bilaspur, Chief Passenger Transportation Manager, Chief Freight Transportation Manager, Chief Commercial Manager & Chief Operations Manager of Central Railway and Executive Director, Traffic Transportation (Movement) in Railway Board.
He was a part of the Indian Delegation which visited USA and China in 2005-06 in connection with Wagon/Bogie designs and Freight Operations.
He is credited with huge improvements in freight loading and punctuality performance in Central Railway and North Western Railway.

Sub: Feedback on the meeting held with the Member Staff, Railway Board


In the meeting held today, i.e. on 23rd May, 2011, between the undersigned and Member Staff, Railway Board, wherein Adviser(IR), EDPC-I and EDF(E) were also present, the following deliberations were made on some of AIRF’s demands for which “All India Protest Day” was observed on 18th May, 2011 all over the Indian Railways :-

1. Payment of arrears of Overtime w.e.f. 1.1.2006 – Orders to this effect have already been issued.
2. Settlement of pensionery dues to Construction Organization Staff on last pay drawn – It was ensured that necessary orders will be issued in a day or two.
3. Arrears to Running Staff w.e.f. 1.1.2006 , improvement in the rate of ALK and 25% enhancement in Mileage Allowance – This issue will be discussed after collecting necessary data on 8th June, 2011.
4. Filling-up of vacancies – Efforts are on and 16,000 vacancies in GP Rs.1800 have been filled-up by Ex-servicemen. Efforts are on for further recruitment of 47,000 employees in GP Rs.1800. It is expected that a panel of 30,000 group `C’ staff will be available by the end of July, 2011. I insisted that even then there will be large number of vacancies. It was agreed that, to fill-up remaining vacancies in group `C’, possibilities for conducting GDCE will be explored.
5. Recruitment of Substitutes – The issue of recruitment of Substitutes was also discussed but remained inconclusive.

6. Anomalies – Various anomalies referred to MoF will be pursued by the Railway Ministry(Railway Board) and the outcome will be made available to the Federation shortly.

7. Constitution of High Powered Committee – Constitution of High Powered Committee to review duty hours of Running and Safety Categories Staff has already approved by Hon’ble MR and is under process of notification.
8. Joint Committee on Trackmen(Gangmen) – Meeting of the Joint Committee on Trackmen(Gangmen) is already fixed for 2nd June, 2011 and hope, recommendations of the said
committee will be finalized in this meeting.
9. Cadre Restructuring – Process of cadre restructuring has started on 20.5.2011, and the same will be progressed further.
10. LARSGESS – Member Staff agreed to review appointment of the wards of the Railwaymen under LARSGESS like compassionate ground appointment, and for that, further action will be taken in consultation with Zonal Railways.
11. Absorption of quasi-administrative offices staff in the Railways – Member Staff agreed to pursue the matter further.
Hopefully, inconclusive meeting of the DC/JCM will take place on 3rd June, 2011.

Railways to consider jobs to children in lieu of VRS

Job in lieu of VRS

Making the safety-related voluntary retirement scheme (VRS) more lucrative, Railways today said it is considering a move to provide employment to the ward of an employee availing the scheme as well as relaxing the age limit under it.

At present, the scheme is available to only gangmen in group D and drivers in group C attaining the age of 55 to 57 years.

Under the new proposal, the scheme will be extended to all safety category staff like pointsmen, khalasi and others.

The age limit will be reduced to 50 years and a ward of the staff will get employment on availing the scheme.

“We are considering the move to provide employment to the ward of a railway employee availing the scheme,” Railway Minister Mamata Banerjee said attending a All India Running staff Conference organized by All India Railwaymen’s Federation today on 13 July, 2010 at New Delhi

Shri Vivek Sahai takes over as Chairman, Railway Board, in New Delhi on May 31, 2010.

Shri Vivek Sahai has taken over as the new Chairman, Railway Board and ex-officio Principal Secretary to the Government of India, Ministry of Railways, here today. He replaces Shri S.S.Khurana who superannuated today from this post. Prior to this Shri Sahai has been holding the post of Member (Traffic), Railway Board since 28th December 2009.
Shri Sahai , an IRTS Officer of 1973 batch, has held several key posts on Indian Railways, such as General Manager, Northern Railway, General Manager North Central Railway, Additional Member Traffic, Railway Board, Chief Operations Manager, Western Railway, Divisional Railway Manager, Mumbai, Central Railway, Chief Freight Transportation Manager, Western Railway, Executive Director, Railway Board, New Delhi, Chief Operations Manager, Konkan Railway Corporation Limited. He also has extensive experience in suburban train operations in Mumbai, having worked as Divisional Railway Manager, Mumbai Division of Central Railway and Addl. General Manager, Western Railway where he also handled the aftermath of serial bomb blasts.
Shri Sahai holds a post graduate degree in Science (Physics) from Allahabad University. He has been trained in US Rail Roads & SNCF (French Railways) under UNDP Project in the year 1989. He was also part of an Indian delegation which was sent to study the privatization of British Railways in 1996. He has also participated in advanced leadership programme held at Stern Business School, New York, USA in 2007.

All 20 RRB Chairmen changed by MAMATA, in a doubt that they are LALU’s men

सभी आरआरबी चेयरमैनों को एकसाथ हटाना बेहद विवादस्पद निर्णय


आखिर रेलमंत्री सुश्री ममता बनर्जी ने सभी २० आरआरबी चेयरमैनों को एकसाथ हटाने का आदेश ५ नवम्बर को जारी कर दिया. रेलमंत्री का यह निर्णय एक बेहद क्रूर और विवादास्पद निर्णय माना जा रहा है. जबकि होना तो यह चाहिए था कि यदि उन्हें इन चेयरमैनों को हटाना ही था तो सर्वप्रथम उन्हें हटाया जाता जिनका कार्यकाल पूरा हो गया था, फिर इसके बाद दूसरी लात में उन्हें हटाया जाता जिनका कार्यकाल पूरा होने वाला था. इस प्रकार इस मिड टर्म में इन अधिकारियों के बच्चों कि पढाई बर्बाद होने से बच जाती. क्योंकि इन अधिकारियों में अधिकाँश को तो अभी आरआरबी में पदस्थ हुए एक साल भी नहीं पूरा हुआ था.
इसके अलावा इन अधिकारियों का यह असमय ट्रान्सफर किसी भी नियम - कानून के अनुरूप भी नहीं है. सिर्फ इस आशंका या आरोप के चलते इन सभी अधिकारियों को एकसाथ हटा देना कतई उचित नहीं कहा जा सकता कि ये सब पूर्व रेलमंत्री लालू प्रसाद यादव के आदमी थे. अब यदि इनमें से कोई एक भी अधिकारी रेलमंत्री के इस क्रूर निर्णय को थोड़ी सी हिम्मत दिखाकर अदालत में चुनौती दे दे तो रेल मंत्रालय को लेने के देने पड़ सकते हैं.
हमारे विश्वसनीय सूत्रों का कहना है कि इस सब कारगुजारी के पीछे त्रिन मूल कांग्रेस के एक सांसद मुकुल राय का हाथ है. सबसे पहले उन्होंने ईडी/आरआरबी के पद से श्री आनंद माथुर को हटवाया जो कि इस पद पर अभी मुश्किल से ६ महीने पहले ही पदस्थ हुए थे. अब इस पद पर जिन्हें लाया गया है एक तो वह स्टोर सर्विस के हैं दूसरे उनकी छवि भी बहुत अच्छी नहीं बताई जाती है. इसके अलावा नए पदस्थ किये गए चेयरमैनों में आईआरपीएस सर्विस के मात्र ३ अधिकारियों को ही लिया गया है जबकि इससे पहले जो निर्णय हुआ था इसके अनुसार आरआरबी चेयरमैनों के पद पर ज्यादातर आईआरपीएस सर्विस के अधिकारियों को ही पदस्थ किया जाना था.
इससे पहले जब १९ अक्तूबर को १८ आरआरबी चेयरमैनों को शिफ्ट करने कि फाइल मूव कि गयी थी तब 'रेलवे समाचार' ने इस बारे में सीआरबी सहित सेक्रेटरी/रेलवे बोर्ड और सभी बोर्ड मेम्बरों को मोबाइल सन्देश भेजकर ऐसा कोई विवादास्पद निर्णय न लेने तथा उपरोक्त तरीके से चेयरमैनों को हटाने के बारे में अविलम्ब रेलमंत्री के संज्ञान में यह मामला लाये जाने के लिए सभी बोर्ड मेम्बरों को अवगत कराया था। जिसके परिणाम स्वरुप तब यह मामला स्थगित कर दिया गया था. ५ अक्तूबर को जिस दिन यह फाइल पुनः रेलमंत्री के एपीएस श्री गौतम सान्याल को भेजी गयी थी उस दिन भी 'रेलवे समाचार' ने ऐसा ही एक सन्देश भेजकर सभी बोर्ड मेम्बरों को अवगत कराया था. मगर जिनकी इस मामले में सबसे ज्यादा जिम्मेदारी बनती है जब वह मेंबर स्टाफ स्वयं मेंबर ट्रेफिक बनने के ख्वाब में अपनी सारी हड्डियों को दोहरा करते हुए साष्टांग हुए जा रहे हों तब सिस्टम को चौपट होने से कौन बचा सकता है?
सुश्री ममता बनर्जी ने रेलमंत्री का पद ग्रहण करने के तुंरत बाद मीडिया को दिए गए अपने पहले बयान में कहा था कि वह रेलवे बोर्ड का पुनर्गठन करेंगी और सीआरबी तथा सेक्रेटरी, रेलवे बोर्ड को भी हटा सकती हैं. इनमें से वह किसी को भी नहीं हटा पायीं, क्योंकि सीआरबी पर पीएमओ का और सेक्रेटरी पर लालू का ठप्पा लगा हुआ है. जबकि सेक्रेटरी/रेलवे बोर्ड के पद पर बैठा अधिकारी न सिर्फ कई अधिकारियों से जूनियर है बल्कि महाभ्रष्ट भी है, इस बात से न सिर्फ सभी रेल अधिकारी वाकिफ हैं बल्कि स्वयं रेलमंत्री भी अब इस तथ्य से भली - भांति अवगत हैं. इससे पहले 'रेलवे समाचार' भी सेक्रेटरी के भ्रष्टाचार और उनका लालू का पिट्ठू होने के सारे तथ्य विस्तार से प्रकाशित कर चुका है.
रेलमंत्री ममता बनर्जी को पश्चिम बंगाल की अपनी राजनीति से फुर्सत नहीं है जबकि बोर्ड में पदस्थ उनके तमाम सिपहसालार रेलवे की तमाम तकनीकी कार्य प्रणाली से नावाकिफ हैं. तथापि सुश्री ममता बनर्जी रेल मंत्रालय को पार्ट टाइम ही चलाना चाहती हैं, जो कि नामुमकिन है. इसलिए यदि चारों तरफ लगातार रेल दुर्घटनाएं हो रही हैं और इससे सुश्री ममता बनर्जी की 'क्षणिक बुद्धि' छवि और भी ज्यादा ख़राब हो रही है तो उसका दोष स्वयं ममता बनर्जी पर ही जा रहा है. रेलमंत्री का अपने रेल मंत्रालय की तरफ ध्यान न देने का ही परिणाम है की रेलवे में चारों तरफ भ्रष्टाचार का बोलबाला हो रहा है.-- रेलवे समाचार

नई दिल्ली : मथुरा में हुई दो ट्रेनों की दहशतनाक टक्कर के तुंरत बाद ठाणे, मुंबई में २३ अक्तूबर को ट्रैक के ऊपर पुल का गर्डर/pa[plaa[na गिरने saoहुई दर्दनाक घटना और लगातार ३०-३५ घंटों तक सभी ट्रेनों के बंद रहे आवागमन से मुंबई के लाखों दैनिक रेल यात्रियों की परेशानी को देखकर और शायद इससे होने वाली अपनी भारी आलोचना से बचने के मद्देनजर रेलमंत्री सुश्री ममता बनर्जी ने २३ अक्तूबर को ही आनन - फानन रेलवे बोर्ड पहुंचकर पुरे बोर्ड की इमरजेंसी मीटिंग बुलाकर सभी अधिकारियों की लम्बी खिंचाई का डाली।
सूत्रों का कहना है की ममता ने अधिकारियों को सामानों की खरीद और आउट सोर्सिंग तथा टेंडर सिस्टम में अपनी कमीशनखोरी खत्म करने को कहा है। सूत्रों का तो यहाँ तक कहना है की ममता ने इसके लिए वास्तव में 'कट' जैसे टपोरियों की भाषा के शब्द का साफ़ इस्तेमाल किया जिससे ईमानदार अफसरों के होठों पर भी मुस्कराहट उभर आई, यह देखकर रेलमंत्री भी उनका मंतव्य समझकर हलके से मुस्कराए बिना नहीं रह सकीं।
रेलमंत्री के आदेश पर एक तरफ़ पैलेस ऑन व्हील्स का मजा ले रहे दक्षिण पूर्व रेलवे के महाप्रबंधक श्री ए.के.जैन को उनकी छुट्टियाँ रद्द करके तुंरत वापस बुलाया गया तो दूसरी तरफ़ उनके और लालू के सबसे बड़े सिपहसालार रहे सीऍफ़टीएम्/द.पू.रे.श्री बी.डी.राय, जो की इस पड़ पर पिछले करीब ५ सालों से बिराजमान थे, को तुंरत प्रभाव से इस पद से हटा दिया गया है जिससे तमाम अफसरों के कलेजे को काफी ठंढक मिली है क्योंकि लालू वरदहस्त होने के कारण श्री राय अपनी मनमानियों के चलते बहुतों को अपना दुश्मन बना लिए थे।
उधर मथुरा के पास हुई ट्रेनों की टक्कर और उसमें दो दर्जन से ज्यादा मौतों के लिए जिम्मेदार ठहराकर ममता ने आगरा मंडल के मंडल रेल प्रबंधक श्री के.जी.त्रिपाठी को उनके पद से हटा देने का आदेश दिया है।
२३ अक्तूबर की इमरजेंसी बोर्ड मीटिंग में बताते हैं की रेलमंत्री ने न सिर्फ़ रेल अधिकारियों की सभी विदेश यात्राओं पर अगले एक साल तक के लिए प्रतिबन्ध लगा दिया है बल्कि पिछले ५ वर्षों के दरम्यान जितने भी फ्रेट रेकों का एलाटमेंट हुआ है सभी की जाँच सीबीआई से कराने को कहा है। सूत्रों का कहना है की रेलमंत्री ने आउट ऑफ़ टर्न रेक एलाटमेंट की गलत परंपरा को तुंरत प्रभाव से रोक देने को कहा है.

Sub: Classification of non-gazetted posts as Selection/Non-Selection; consequent to the revision of pay structure as recommended by the 6th Central Pay Commission – status of promotions made between 01.01.2006 and 01.09.2008 within merged grades

Ref: Rly. Board’s letter No. E (NG)I-2008/PM1/15 dated 28.08.2009

Taking all the factors, enumerated in the Board’s letter, into consideration, AIRF is of the view that the staff duly promoted between the period 01.01.2006 to 30.08.2008 after observing all the relevant rules and procedures then prevailing should be allowed to enjoy the same. However, such staff may be allowed to opt either to retain promotion or to forgo the same by an act of positive option within a period of 3 months of such notification.

In the event of exercising option to come-over to VI CPC, such of the pay from a later date than 01.01.2006, payment already made as arrear should be allowed as such i.e. if, any over payment has already been made on the account of fixation of pay in the revised scale w.e.f. 01.01.2006, the same should be waived seeking relaxation of Rule 5 of RSRP in this regard as per power vested with the Government under Rule 16 of RSRP.

18 हजार ट्रेन कर्मचारियों के लिए 15 अरब डॉलर आईटी सिस्टम आपग्रेड करेगी

आधुनिक टेक्नोलॉजी से रेलवे में हो रहा परिवर्तन


अब तक रेलवे ड्राइवर को ट्रेन सौंपने का कार्य मैन्युअली करती थी. पहले यह तय नहीं था और विद्यमान ड्राइवर को यह जानकारी भी नहीं होती थी कि अगले स्टेशन पर ड्यूटी समाप्त होने पर वह इंजन किस ड्राइवर को सौंपेगा, परंतु अब ऐसा नहीं रहेगा. अब रेलवे में नई टेक्नोलॉजी के कारण स्थिति में बहुत परिवर्तन आया है. अब भारतीय रेल के 18,000 ट्रेन चालक दल, नई क्रू प्रबंध सिस्टम (सीएमएस) का लाभ उठाएंगे. यह एक इनहाऊस ड्राइवर डिक्लप्ड सॉफ्टवेयर है. इसमें बायोमेट्रिक पहचान अर्थात ड्राइवर की पहचान की व्यक्तिगत सांख्यिकी होगी और इसी पहचान के आधार पर ट्रेन आवंटन होगी. इस सिस्टम में प्रत्येक इंजिन क्रू के विवरण रहेंगे. इसी के आधार प्रत्येक चालक और ट्रेन का टाइम टेबल पहले से ही निर्धारित रहेगा. भारतीय रेलवे 37,000 करोड़ के बजट वाली एक स्वतंत्र और सर्वोपरि अर्थव्यवस्था है. प्रतिदिन 18,000 सवारी गाडिय़ों में 1.80 करोड़ यात्री यात्रा करते हैं. आगामी तीन वर्षों के अंदर-अंदर इस सॉफ्टवेयर को अपग्रेड करने के लिए 15 अरब डॉलर व्यय होने की संभावना है.
चालक दल को योग्य रीति से काम मिलेगा. राजधानी, शताब्दी और सामान्य एक्सप्रेस ट्रेनों को चलाने/संचालन के लिए एक अलग विशिष्ट कौशल्य की जरूरत होती है. डीजल और विद्युत संचालित इंजनों के लिए भी विशिष्ट कौशल जरूरी है. अब हम चालक दल के सदस्य और उनके नंबर पर सर्च कर यह जान सकते हैं कि वह इस समय कहा है. सेंटर फार रेलवे इंफोर्मेशन सिस्टम (सीआरआईएस) CRIS ने वर्ष 2006 में क्रू मैनेजमेंट पाइलट प्रोजेक्ट शुरू किया है. इससे अब चालक दल के सदस्यों को उनके परिजन जान सकते हैं कि वे इस समय कहा हैं.

Sub : Anomaly in fixation of pay of Loco Supervisory staff appointed prior to 01.01.2006 with reference to their juniors appointed after 01.01.2006 and drawing more pay than the seniors.

It has come to the notice of the Board that staff appointed prior to 1.1.2006 as Loco Running Supervisors in the pre-revised pay scales, whose pay has been fixed in the replacement pay structure for Loco Running Supervisors under the RS(RP) Rules, 2008, are drawing less pay than their juniors appointed as Loco Running Supervisor after 1.1.2006. The anomaly has arisen due to the fact that the benefit of element of Running allowance granted at the time of promotion of running staff to a stationary post has been granted to the junior in the revised pay structure, whereas, the same benefit granted to the senior is of lesser value as the same has been calculated on pre-revised pay scale.

2. It has been decided that the anomaly may be resolved by granting stepping up of pay in pay band to the seniors at par with the juniors in terms of Note 10 below Rule 7 of RS (RP) Rules, 2008.

3. The benefit of stepping up of pay in pay band will be subject to the following conditions:-

(a) Both the junior and the senior Railway servants should belong to the same cadre and the posts in which they have been promoted should be identical in the same cadre and other conditions enumerated in Note 10 below Rule 7 of RS(RP) Rules, 2008 should also be fulfilled.

(b) The stepping up of pay will be allowed to running staff only appointed as Loco Supervisors in whose cases 30% of basic pay is taken as pay element in the running allowance. The stepping up of pay will not be admissible to the nonrunning staff of Mechanical Deptt. Appointed as Loco Running Supervisors as in their cases the question of pay element in the running allowance does not arise;

(c) If even in the lower post, revised or pre-revised, the junior was drawing more pay than the senior by virtue of advance increments granted to him or otherwise, stepping up will not be permissible;

(d) Stepping up will be allowed only once, the pay so fixed after stepping up will remain unchanged

(e) The next increment will be allowed on the following 1st July, if due, on completion of the requisite qualifying service with effect from the date of refixation of pay, as per the provisions of Rule 10 of RS(RP) Rules, 2008.

4. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

SERVICE TAX: RLY GOODS TRANSPORT WILL BE TAXABLE

SERVICE TAX CHANGES IN BUDGET 2009

Amendments proposed by Finance Bill, 2009 SERVICE TAX

(A) Following New Services are brought under Service Tax Net,

(i) Transport of goods by rail,

Transport of Goods through Rail

Presently, transportation of goods in containers by rail, by other than Government railways is taxable under Section 65(105)(zzzp) of the Finance Act, 1994 (‘the Finance Act') since 2006. It is now proposed to impose service tax on goods transported by railways, whether in containers or otherwise.After application of this clause the Freight on all good through railway will be cost more .

(ii) Transport of,

· Coastal goods; or

· Goods through national waterway; or

· Goods through Inland water

(iii) Service in relation to Cosmetic surgery or Plastic surgery

This service proposes to cover cosmetic surgery and plastic surgery undertaken to preserve or enhance physical appearance or beauty. However, any surgery undertaken to restore or reconstruct one's anatomy or bodily functions affected due to congenital defects, developmental abnormalities, degenerative diseases, injury or trauma is outside the scope of this service.

(iv) Services in relation to Advice, Consultancy or assistance in any branch of law, provided by any business entity not being an individual

Service provided in the field of law except in case where service provider or service recipient is an individual. Thus tax would be limited to services provided by a business entity to another business entity and services provided by an individual advocate either to an individual or even to a business entity and by a corporate legal firm to an individual would be outside the purview of taxable service. Further service of appearance before any court of law or any statutory authority is also outside this levy.

Proposed clause is

“(zzzzm) to a business entity, by any other business entity, in relation to advice, consultancy or assistance in any branch of law, in any manner:

Provided that any service provided by way of appearance before any court, tribunal or authority shall not amount to taxable service.

Explanation.—For the purposes of this sub-clause, “business entity” includes an association of persons, body of individuals, company or firm, but does not include an individual;”

The date of effect of the above new services will be Notified in the notification.(not known yet)


(B) Following amendments have been proposed in relation to existing service

  • (i) The definition of stock-broker has been amended so as to exclude the sub-broker from its net. Hence, sub-broker shall not be liable to service tax anymore.

The words ‘sub-broker' has been deleted from charging provisions of the Finance Act, which defines ‘stock broker' .  This has been necessitated as in terms of the amended provisions of SEBI Rules, sub-broker has no independent role as he is not authorized to raise any bill on the clients.

  • (ii) The definition of “Information Technology Software Services” has been amended to replace the word ‘acquiring’ with ‘providing’. This amendment is being given retrospective effect,

Exclusion clause in this service has been modified to provide that it would apply only if the activity results in manufacture of ‘excisable goods'. The impact of this change would be that even if a process of manufacture is undertaken for the customer, but the resultant product does not fall under the category of excisable goods, such as alcoholic beverages, service tax would be attracted.

  • (iii) The definition of “Business Auxiliary Services” has been amended so as to provide that only those processes which result in the manufacture of excisable goods, are excluded from the purview of Business Auxiliary Services

Exclusion clause in this service has been modified to provide that it would apply only if the activity results in manufacture of ‘excisable goods'. The impact of this change would be that even if a process of manufacture is undertaken for the customer, but the resultant product does not fall under the category of excisable goods, such as alcoholic beverages, service tax would be attracted.

(C) The following amendments has been proposed in the rules and notifications

(1) Rule 6(3) of Cenvat Credit Rules, 2004 has been amended to prescribe that the provider of both taxable and exempted services, and who does not maintain separate books of accounts relating to inputs, shall pay an amount equal to 6% of the value of exempted services instead of 8%.

(2) Rule 3(5B) of Cenvat Credit Rules, 2004, is being amended to provide that a service provider shall pay back the amount of credit taken on inputs/capital goods fully written off.

(3) Explanation provided in the Works Contract Rules, 2007 is being modified so as to allow the benefit of optional composition only to such works contracts where the tax payer declares the entire value of goods (whether supplied under any other contract for a consideration or otherwise) and services used in the execution of works contracts as the ‘gross value charged’ for the works contracts. This restriction shall not be applicable to current works contracts where either the execution has commenced or any payment has been made on or before 07.07.2009.

Exemption Scheme
(1) To simplify the Scheme of Zero-rate export and refund of service tax paid after clearance of exportable goods from the factory, Following major changes have been proposed;

  • (i) Services received by exporters from goods transport agents and commission agents, where the liability to pay service tax is ab initio on the exporter, would be exempted from service tax. Thus, there would be no need for the exporter to first pay the tax and later claim refund.
  • (ii) For other services received by exporters, the exemption would be operated through the existing refund mechanism based on self-certification of the documents where such refund is below 0.25 per cent of fob (free on board) value, and certification of documents by a Chartered Accountant for value of refund exceeding the above limit.

(2) Exemption from levy of service tax on the membership and other fees colleted by Export Promotion Councils and Federation of Indian Export Organization (FIEO) till 31st March, 2010

NEW DELHI: Indian Railways has over 1.7 lakh vacancies which will be filled after the current recruitment process is reviewed, Railway Minister
Mamata Banerjee informed the Rajya Sabha.
Replying to questions, she said the Railway Recruitment Board (RRB) is being reviewed. "We have to examine (the recruitment process) and address lacunae. We will come back once we have done the review."
She said there were issues of regional aspirations and problems in Maharashtra, Karnataka and Guwahati over RRB exams. "We are reviewing the entire process."
Of the total sanctioned strength of 15,66,964 employees, there were 1,72,444 vacancies, she said. Most of the vacancies were in Group 'C' at 1,12,566, followed by Group 'D' at 58,329. There are 1,549 vacancies in A and B, she said.
"Any large organisation like the Railways will have certain vacancies at any point of time. Arising of and filling up of vacancies is a continuous process," she said. "Vacancies arise due to normal retirement, voluntary retirements, deaths, promotions or creation of posts. Vacancies are filled primarily through open market recruitment and promotions."
To a separate question, she said there was a backlog of 1,814 vacancies of SCs in Group 'C' service of the Railways and 1,688 for STs. There is no backlog of vacancies of SC and ST in recruitment for Group A and B.

Lucknow (PTI) The Railway Board has been asked by Uttar Pradesh police to cancel four of its tests held recently in different parts of the country following a series of arrests in connection with leakage of question papers.
"Based on the report of the Special Task Force, which busted the paper leak racket, the state police had sent a letter a member of the Railway Board A K Goel with a recommendation to cancel four examinations held earlier this year," Additional Director General of Police, UP, Brij Lal told PTI on Thursday.
The examinations were conducted on December 16, January 18, February 8 and February 15.
He said the UP police had concrete evidence that the question papers of all the four examination, including one conducted by Ajmer Railway Recruitment Board in February, were leaked.
"We sent a detailed report to the railway board on April 8, which included a CD containing conversation between the members of the racket based in Bihar," he said.
On February 15, as many as 109 persons including 15 gang members, were arrested from different places in Bhopal and Jaipur on a tip off from the UP Police.
The written test for the post of assistant station master by the RRB Ajmer was to be held on the same day.

A lot of defect need to be removed from railway system and action from Railway Board New Delhi Required.

In a joint operation by police  of three States, an alleged racket involving leaking of Railway Recruitment Board (RRB) examination papers was busted on Sunday with the arrest of 109 people, including some aspiring candidates, after raids in Jaipur and Bhopal.

Following the arrests, the written test for the post of Assistant Station Master by the RRB, Ajmer scheduled on Sunday was postponed and a new date would be announced later, the board’s chairman C L Bharti said.

While the arrests were made in Jaipur and Bhopal by the police of the respective states, they were working on a tipoff from Uttar Pradesh Police. “With the help of Rajasthan SOG and Bhopal Police raids were carried out in Jaipur and Bhopal.

Lal said, “Bediram, who was a travelling ticket examiner in NE Railway, is the mastermind. In December last year he was arrested from Allahabad by the STF, which busted a similar racket there, and was released on bail recently.” He said after he was nabbed by the STF, the railways terminated Bediram’s services. “We are trying to nab the kingpin, who is at large since being released from jail,” he added.

Brij Lal said that in December last year; the STF busted a gang leaking question papers for a railway examination, in which a few aspirants were also arrested.

“Since then the state police was tracking the gang members. Through electronic surveillance, we came to know that they have leaked the question paper of an examination being conducted by RRB Ajmer today,” he said.

The ADG said that based on the surveillance inputs two teams of UP STF were constituted to crack the network.

In Jaipur, ADG Kapil Garg, ATS & SOG, Rajasthan told reporters that the gang used to charge Rs 4 lakh per candidate. They used to tell aspiring candidates to initially pay Rs 1,000 and submit their original documents including mark sheets and certi?cates as collateral security before the examination.

Aspiring candidates would then have to pay a second instalment of Rs 50,000 after they had been able to match the leaked question paper with the actual one and ?nal payment of the balance amount had to be paid on their selection, Garg said.

Shri S.S. Khurana has taken over as the new Chairman, Railway Board and ex-officio Principal Secretary to the Government of India, in New Delhi on February 02, 2009.

Shri S.S. Khurana has taken over as the new Chairman, Railway Board and ex-officio Principal Secretary to the Government of India, Ministry of Railways. Prior to this he has been holding the post of Member (Staff), Railway Board since 28th December 2007. Born in the year 1950, Shri Khurana did Electrical Engineering from University of Roorkee (Now IIT/Roorkee).
As officer of 1971 batch of the Indian Railway Service of Electrical Engineering (IRSEE), Shri Khurana worked in various capacities in Indian Railways. He also served as General Manager, East Coast Railway, General Manager/Eastern Railway, Additional General Manager, Northeast Frontier Railway, Chief Electrical Engineer in the Central Organization for Railway Electrification (CORE), Allahabad, Divisional Railway Manager, Adra (SER), Additional Divisional Railway Manager, Dhanbad, Chief Project Manager, Railway Electrification at Ambala and has also worked in the research and design aspects of electric locomotives in the Research, Design & Standards organization, Lucknow.
He has also received valuable experience in foreign training in Sweden, Japan and USA. He has also attended Advance Leadership Programme at Stern Business School, New York, USA.

6. Periodical re-examination of serving Railway Employees:



6.l. In order to ensure the continued ability of Railway employees in Classes A l, A 2, A 3, B l and B 2 to discharge their duties with safety, they will be required to appear for re-examination at the following stated intervals throughout their service as indicated below:



6.1.1. Classes A l, A 2 and A 3 —At the termination of every period of three years, calculated from the date of appointment until they attain the age of 45 years, and thereafter annually until the conclusion of their service.



Note: (l) The staff in categories A l, A 2 and A 3 should be sent for special medical examination in the interest of safety under the following circumstances unless they have been under the treatment of a Railway Medical Officer.



(a) Having undergone any treatment or operation for eye trouble irrespective of the duration of sickness.



(b) Absence from duty for a period in excess of 90 days.



(2) If any employee in medical category A has been periodically medically examined at any time within one year prior to his attaining the age of 45, his next medical examination should be held one year from the due date of the last medical examination and subsequent medical examination annually thereafter.



If, however, such an employee has been medically examined, at any time earlier, than one year prior to his attaining the age of 45, his next medical examination should be held on the date he attains the age of 45 and subsequent medical examination annually thereafter.
