High Power Committee on HoER Constituted

With the efforts of AIRF High Power Committee has been constituted to review duty hours of running staff and other safety related staff.

GOVERNMENT OF INDIA MINISTRY OF RAILWAYS (RAILWAY BOARD)

No:ERB-1/2011/18                    New Delhi dated 25.05.2011

Ministry of Railways(Railway Board) have decided to constitute a High power Committee to review the duty hours of running and other safety categories of staff on Railways under the chairmanship of Sri DP Tripathi, Ex Secretary, Ministry of Food processing Industries. The other members of the committee will be as under.

 >Shri DP Tripathi, Chairman

>Shri Anil Kumar Gulati, Secretary

i) Shri VK Manglik, Ex GM, West Central Railway - Member.

ii) Shri. MS Khan, Ex.AM/Finance/Railway Board -Member

iii) Shri DS Baveja,Ex CEE, Western Railway - Member

Shri Anil Kumar Gulati, Chairman, HRRC, Railway Board will be Secretary to the Committee.

2. The Committee would examine, review and recommend on the following

i) Daily/weekly duty hours and rest at head quarters and out station for the running staff in all categories of trains.

ii)To review list of safety categories on the Railways, and recommend daily/weekly duty hours and weekly off for the staff in safety categories.

iii)Monetary compensation for work beyond duty hours/breach of rest in exigencies of service for running staff/staff in safety categories.

iv) Resting facilities and other provisions for out station rest of running staff , and

v) Any other issue ancillary to the above or which may be specifically referred to the committee by the Railway Board during its tenure.

3) The head quarter of the committee will be at New Delhi.

4) The tenure of the committee shall be for one year from the date of its constitution.

    Present scenario of trade union status of Operating categories over Indian Railways needs to be understood in new manner.
    Though AIRF and NFIR are part and parcel of Workers participation in management through JCM / PNM mechanism.
    History of Railway Board is such that working class particularly Operating staff never got a fair deal.
    Even today about 03 lac Railway employees are employed under 12 hrs. per day duty / 72 hrs weekly.
    Is it not surprising that India being one of the largest in size members of ILO, and one of the signatories of ILO convention of 08 hrs. duty ratified by The Parliament, Indian Railways is still to formulate measures to bring to equitable justice the HOER to 08 hr duty to all railway employees.
    Under AIRF and NFIR -- Railway employees form largest group of Organized and most represented work force in India. Despite this 08 hrs. duty is not available to all in last six decades.
    During 1974 AIRF led agitation 08 hrs. Duty was one of the main demands yet to be achieved.
    From the above i would like to draw few important facts before all of you;--
    1. The main reason is excessive powers to The Railway Board through Chairman Railway Board being ex-offico - Principal Secy. to the Govt. of India. No business head is ever an Administrator too. This aspect is very important for policy makers and trade union leaders to consider.
    2. The result of excessive powers to Railway Board is that " on 13-08-29173 loco Runningmen signed an agreement for Signing On to Signing Off duty 10 Hrs-----with the labor minister of India -- The agreement was accepted and Greated by The Parliament - next day, but this agreement is yet to be implemented"
    Had Chairman Railway Board not been Secy. to Govt. of India, The Agreement would have been in force today."

    3. While dealing with loco running staff the railway board officials are depressed to an extent that often say -- EDPC-1 Said to me in 2009 -- your 30% pay element should be reduced as you draw higher salaries. This view clearly reflected in Railway Board Denied Rates of KMA on the basis of formulae accepted by 4th and 5th pay commission, even though the 6th pay commission clearly refused to give any new formulae or deny the old formulae.

Subject: Implementation of the Recommendations of the Visual Sub-Committee.



6. Periodical re-examination of serving Railway Employees:



6.l. In order to ensure the continued ability of Railway employees in Classes A l, A 2, A 3, B l and B 2 to discharge their duties with safety, they will be required to appear for re-examination at the following stated intervals throughout their service as indicated below:



6.1.1. Classes A l, A 2 and A 3 —At the termination of every period of three years, calculated from the date of appointment until they attain the age of 45 years, and thereafter annually until the conclusion of their service.



Note: (l) The staff in categories A l, A 2 and A 3 should be sent for special medical examination in the interest of safety under the following circumstances unless they have been under the treatment of a Railway Medical Officer.



(a) Having undergone any treatment or operation for eye trouble irrespective of the duration of sickness.



(b) Absence from duty for a period in excess of 90 days.



(2) If any employee in medical category A has been periodically medically examined at any time within one year prior to his attaining the age of 45, his next medical examination should be held one year from the due date of the last medical examination and subsequent medical examination annually thereafter.



If, however, such an employee has been medically examined, at any time earlier, than one year prior to his attaining the age of 45, his next medical examination should be held on the date he attains the age of 45 and subsequent medical examination annually thereafter.




Ammendment: It was ammended in 1993 as below



Age Group PME Due



Age 00-45 every 4yrs



Age 45-55 every 2yrs



Age 55-60 every year
Details:-
As per Rly Bd's Guideline of Medical Exam issued vide LNo. 88/H/5/12 dated 24-01-1993

a) PME would be done at the termination of every period of 4 years from date of appointment / Initial medical Exam till the date of attainment of age of 45 years, every 2 years upto 55 years & there after annual till retirement.
b) Employees who has been periodically examined at any time within 2years prior to his attaining the age of 45years would be examined after 2years from the date of last PME & subsequent PME for every 2years upto 55years age.Of
